Acceptance, legal capacity and eligibility

These Terms form a binding agreement between you and the operator of ELARUNE AI (“ELARUNE”, “we”, “us”). By creating an account, clicking acceptance, accessing the service or buying credits, you agree to these Terms, the Privacy Policy and the 18+ Content Policy.

You must be at least 18 years old, have reached the age of legal majority where you live, and have legal capacity to enter this agreement. You may not use ELARUNE where access to the service, generative AI, adult material or cryptocurrency payments is prohibited. You must provide an accurate birth date, country or region and account information.

Service and AI-generated material

ELARUNE provides tools that submit prompts and optional reference media to artificial-intelligence model providers. Outputs are probabilistic: they may be inaccurate, unexpected, similar to other outputs, unavailable or rejected. We do not promise that any prompt will produce a result or that an output will be suitable for a particular purpose.

Model availability, specifications, moderation and processing times may change. Third-party model, infrastructure and payment providers may impose additional technical or content restrictions. You remain responsible for reviewing every output before using, publishing or relying on it.

Accounts and security

One person may not operate accounts to evade limits or enforcement. Keep credentials secure, do not sell or share access, and notify official support promptly of suspected compromise. You are responsible for activity performed through your account unless applicable law provides otherwise.

Email verification, anti-bot checks, age gates and other safeguards may be required. They reduce abuse but are not identity warranties. We may request additional proof where reasonably necessary for safety, compliance, consent or dispute handling.

Your prompts, uploads and permissions

You retain rights you already hold in prompts and uploads. You grant ELARUNE and its contracted processors a limited, worldwide, non-exclusive licence to host, copy, transmit, transform and process that material only as reasonably necessary to operate, secure, moderate and support the service and comply with law.

You represent that you have all rights, permissions and valid consents needed for every upload and requested use. Uploading a person’s image does not itself prove consent. Do not submit confidential, biometric or sensitive material unless you understand and accept the processing described in the Privacy Policy.

Adult-content rules

Access to any 18+ area is limited to adults and is governed by the 18+ Content Policy. Every depicted real person must be an adult who gave informed, specific and freely given consent to the source media, the requested transformation and the intended distribution.

No feature or provider label means that content is automatically lawful. Local rules may ban or restrict adult, synthetic or intimate material even when all participants are adults.

Prohibited conduct and content

• Any sexual or exploitative depiction of a minor, a person presented as a minor, or age-ambiguous subjects; attempts to bypass age or safety controls.
• Non-consensual intimate imagery, sexual deepfakes, coercion, trafficking, exploitation, hidden-camera material, or sexualized impersonation of a real person, public figure or private individual.
• Content that violates law or another person’s privacy, publicity, copyright, trademark or other rights; fraud, harassment, threats, doxxing or deceptive evidence.
• Malware, credential theft, automated abuse, scraping, service disruption, reverse engineering where prohibited, resale of access without authorization, or evasion of rate, account or moderation controls.
• Using outputs to make unlawful decisions about a person, to provide deceptive professional advice, or to represent synthetic media as authentic where that would mislead or cause harm.

Credits, pricing and refunds

Credits are a limited, revocable, non-transferable licence to use eligible ELARUNE features. They are not money, stored value, a deposit, an investment or cryptocurrency and cannot be redeemed for cash. The price shown before generation controls that request; prices and packages may change prospectively.

Credits charged for a generation are automatically returned when ELARUNE records that task as failed, including a provider moderation rejection recorded as a failed task. An invalid request that is never accepted, an abandoned wallet action, or dissatisfaction with a successfully completed probabilistic output does not automatically entitle you to a refund. Except where mandatory law requires otherwise, confirmed digital-asset payments and redeemed codes are final. Contact official support with a specific transaction or service problem.

Wallet and blockchain payments

You control your wallet and authorize transactions. Verify the network, token, amount and destination in your wallet before signing. Blockchain transactions are public, generally irreversible, and may incur network fees. Sending an unsupported token, using the wrong network or paying the same order twice may result in permanent loss.

Credits are issued only after the service detects the required on-chain transfer and confirmation. Wallet displays, RPC providers and blockchains may be delayed, reorganized or unavailable. We never ask for a private key, seed phrase or wallet password.

Storage and five-day media retention

Generated images and videos are temporary working files and may be automatically deleted as early as five days after completion. Failed, expired, unsafe or operational files may be removed sooner. Download anything you wish to keep. Deletion may be irreversible and may occur even if a gallery card or provider copy remains temporarily visible.

Account, consent, credit, payment, security and audit records may be retained separately as described in the Privacy Policy and are not covered by the five-day media window.

Intellectual property and outputs

ELARUNE software, branding, interface and documentation are protected by applicable intellectual-property laws. Subject to these Terms and any third-party rights, we do not claim ownership of your output merely because it was generated through the service.

The law may not recognize exclusive rights in AI-generated material, and similar outputs may be generated for others. We make no representation that an output is unique, protectable, non-infringing or clear for commercial use. You are responsible for permissions, notices and legal review before exploitation.

Moderation, suspension and termination

We may block a prompt, remove material, preserve evidence, limit features, suspend or terminate an account when reasonably necessary to enforce policies, protect people or systems, address fraud or charge disputes, comply with a provider obligation or law, or investigate a report. Serious child-safety or non-consensual-content concerns may be reported to competent authorities where required.

You may stop using the service at any time. Account closure does not undo completed blockchain transactions or obligations that by nature survive, including payment, licence, liability, enforcement and dispute provisions.

Reports, complaints and takedowns

Report suspected non-consensual imagery, child-safety issues, impersonation, infringement, account compromise or payment problems through the official support channel shown on ELARUNE. Include enough information to locate the material or transaction and explain your authority to report it. Do not send seed phrases or private keys.

We may request identity, consent or rights evidence and may notify affected users when fair and lawful. Emergency danger should be reported to local emergency services first.

Disclaimers and limitation of liability

To the fullest extent allowed by law, the service is provided “as is” and “as available”, without warranties of uninterrupted operation, merchantability, fitness, accuracy, legality, non-infringement or availability of any model or output. Nothing excludes warranties or rights that cannot legally be excluded.

To the fullest extent allowed by law, ELARUNE and its processors will not be liable for indirect, incidental, special, consequential or punitive loss, lost profit, lost data, loss caused by wallet mistakes, or reliance on AI output. Where liability cannot be excluded, it is limited to the greater of the amount you paid ELARUNE in the six months before the event or the minimum amount required by law.

Changes, applicable law and contact

We may update these Terms prospectively for legal, safety or product reasons. Material changes will be posted with a new effective date and, when required, additional notice or consent. Continued use after an effective change constitutes acceptance where permitted.

Applicable law, mandatory consumer rights and competent courts depend on the operator’s published legal details and your location. These Terms do not waive protections that cannot be waived and do not select a jurisdiction that ELARUNE has not expressly published. If a provision is unenforceable, the remainder continues.
